05Intellectual Property and Counterfeiting

Ola Cars GmbH is the owner of the intellectual property rights and holds the usage rights over all the elements accessible on the website, notably the texts, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the website, whatever the means or process used, is prohibited, except prior written authorisation by Ola Cars GmbH. Any unauthorised use of the website or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of Articles L.335-2 and following of the Code of Intellectual Property.

06Limitation of Liability

Ola Cars GmbH cannot be held liable for direct or indirect damage caused to the user's equipment when accessing the Ola VIP Cars website, and resulting either from the use of equipment that does not meet the specifications indicated in point 4, or the appearance of a bug or an incompatibility.

Ola Cars GmbH also cannot be held responsible for indirect damages (such as loss of market or loss of a chance) consequent on the use of the Ola VIP Cars website. Interactive spaces (possibility to ask questions in the contact space) are available to users. In France, personal data are notably protected by the law n° 78-87 of 6 January 1978, the law n° 2004-801 of 6 August 2004, the article L. 226-13 of the Penal Code and the European Directive of 24 October 1995, and by the General Data Protection Regulation (GDPR).

Hyperlinks. The Ola VIP Cars website contains a certain number of hyperlinks to other sites. However, Ola Cars GmbH does not have the ability to verify the content of the sites visited, and will not assume any liability in this respect.

10Applicable Law and Jurisdiction

Any dispute in connection with the use of the Ola VIP Cars website is subject to French law. Exclusive jurisdiction is granted to the competent courts of Berlin.
